A groundworker crushed under roughly two tonnes of soil in a trench that had no supports. It's the kind of incident that stops you in your tracks — because every experienced groundworker knows exactly how it happened, and exactly how it could have been prevented.
What happened
According to the HSE Media Centre, Gheorghita Arsene, 33 — known as Geo — died on 24 June 2020 at a site on Park Road, Banstead, Surrey. He had been working at the bottom of a deep trench, replacing a damaged pipe, clearing soil with a shovel and pickaxe when the trench walls collapsed without warning. He was buried in approximately two tonnes of soil and died at the scene despite rescue attempts.
A joint investigation by Surrey Police and the HSE, which ran over five years, found the trench had no supports to prevent collapse and that excavated soil had been deposited immediately next to the edge. The investigation also found that earlier that day, self-employed contracts manager Anthony O'Connor — working for T Vaughan Limited — had observed a worker in the same unsupported excavation. As the HSE put it, he "knew suitable measures were required to prevent a trench collapse but failed to ensure they were implemented."
Following a trial at the Old Bailey on 9 September 2026, principal contractor Appledorn Developments Limited and subcontractor T Vaughan Limited were convicted of breaching Section 3(1) of the Health and Safety at Work etc. Act 1974. T Vaughan Limited was fined £650,000 plus £40,000 costs; Appledorn Developments Limited was fined £500,000. O'Connor pleaded guilty to breaching Section 7 and was sentenced to 10 months' imprisonment, suspended for 18 months, plus 150 hours of unpaid work.
An HSE spokesperson said Mr Arsene's death "was as horrifying as it was preventable."
Why this matters to contractors
The hazards here are not obscure. Unsupported excavation walls and spoil stacked at the edge are two of the most well-documented causes of trench fatalities in UK construction. A collapse gives no warning — a cubic metre of soil weighs well over a tonne, and once it's on top of you, digging out in time is almost impossible.
What should sit uncomfortably with every contractor is the individual liability. This wasn't only about the companies. A contracts manager who saw the risk with his own eyes and did nothing carried a Section 7 conviction and a suspended prison sentence. If you supervise, plan or manage excavation work, "I noticed but assumed someone else would sort it" is not a defence — it's the whole case against you.
What to check on your site
- Support before entry. No one enters an excavation over safe depth until the walls are properly supported (shoring, trench boxes) or battered back to a safe angle. Inspect before every shift and after any event that could affect stability.
- Spoil placement. Keep excavated soil, plant and materials well back from the edge. Surcharge loading at the edge is a direct collapse trigger.
- Safe access. Provide a safe way in and out — never let people clamber over unsupported faces.
- Competent supervision. Whoever signs off the dig must actually know what "safe" looks like, and must stop work when it isn't.
- Permit and inspection records. A permit to dig with a hold point, plus a documented daily excavation inspection, keeps the decision visible and accountable.
- Underground services. Confirm services are located and de-energised or isolated before hand-digging.
